Mediation is a structured and confidential process in which a neutral mediator facilitates constructive dialogue between parties in dispute. The objective is to find a mutually acceptable resolution, preserve relationships wherever possible, and avoid the cost, delay and adversarial nature of litigation.
Commercial Settlements — When There Is Value but No Cash
Many shareholder, partnership and business disputes eventually reach the same practical conclusion: one party needs to buy out the other.
The difficulty is often not determining the value of the departing party’s interest. The real difficulty is finding the cash to fund the settlement.
A business may have substantial value but limited liquidity. Its wealth may be represented by property, equipment, investments, working capital, intellectual property or the underlying value of the business itself. Neither the company nor the remaining shareholder may have sufficient cash available to fund an immediate buy-out.
This can create an apparent deadlock:
The parties may agree that they need to separate. They may even agree on value. But there is no cash available to make it happen.
We do not regard that as the end of the mediation. It is a financial problem that needs to be solved.

Both parties come together in a structured, facilitated environment to present their perspectives in a controlled setting.
Negotiation & Caucus
The mediator works with both sides — jointly and privately — to explore solutions, identify settlement zones, and bridge gaps.
Settlement Agreement
Once consensus is reached, a formal written agreement is drafted, reviewed, and signed by all parties — creating a binding contract.
Med-Arb Hybrid
If mediation doesn't reach a conclusion, we transition seamlessly into arbitration — ensuring a binding outcome is always reached without redundant proceedings.
